Constitutional Powers

Executive Powers & Checks

The Constitution grants specific powers to the executive branch — and subjects each to checks by Congress and the judiciary.

Commander-in-Chief

The President commands all U.S. armed forces. Only Congress can formally declare war, and the War Powers Resolution limits unilateral military commitments.

Congressional / Judicial Check

Congress declares war; War Powers Resolution requires notification within 48 hours and withdrawal within 60 days without authorization.

Veto Power

The President may veto any bill passed by Congress. A pocket veto occurs when Congress adjourns within 10 days of presenting an unsigned bill.

Congressional / Judicial Check

Congress can override a veto with a two-thirds majority in both chambers.

Treaty Power

The President negotiates and signs treaties with foreign nations. Ratified treaties become the supreme law of the land.

Congressional / Judicial Check

The Senate must ratify treaties by a two-thirds supermajority.

Appointment Power

The President appoints federal judges, Cabinet members, ambassadors, and thousands of other federal officials.

Congressional / Judicial Check

Most major appointments require Senate confirmation by a simple majority.

Executive Orders

The President may issue executive orders directing federal agencies on how to implement law. They carry the force of law but cannot override existing statutes.

Congressional / Judicial Check

Congress can pass legislation overriding an executive order; courts can strike them down as unconstitutional.

Pardon Power

The President may grant pardons, commutations, and reprieves for federal offenses. This power is nearly absolute.

Congressional / Judicial Check

Cannot pardon state crimes or impeachment proceedings. Subject to political accountability.

The Presidential Succession Act establishes the order in which officials assume the presidency if the President is unable to serve.
